An assignment is the transfer of ownership in a mark to a different company or person(s). The applicant is the owner of the mark and submits a trademark application so that the mark may register. If the mark registers, the “applicant” becomes the “registrant.” A registrant may assign ownership of the mark without any restrictions imposed by the USPTO. Until the mark registers, however, the applicant may only assign ownership of the mark to another party if it has submitted an accepted specimen of the mark as used in commerce, unless the other party is the legal successor (by law or contract) to the applicant. An assignment by an applicant to any party other than its successor. before it submits an accepted specimen of the mark as used in commerce, may result in the application or registration being void.
